Is it true McCain and Obama missed the deadline to be on the ballot in Texas?
I am reading Bob Barr is leading a lawsuit charging that Obama and McCain missed the deadline to be on the Texas ballot. Texas law states that candidates must submit the paperwork no later than 5 p.m. on the 70th day before the election is to be held. The fact is that neither Obama or McCain were nominated before that date.
Won't they have to violate Texas law to get their names on the ballot? I guess since they don't follow the U.S. constitution we can't really expect them to adhere to the Texas constitution, right? If everyone follows Texas law, then Barr should be the only one on the Texas ballot....McCain/Obama can't even be write-ins. What do you think?
figure 8: so if Barr wasn't nominated by the Libertarian party prior to the deadline date they would still let him on the ballot? NO WAY!

Technically (which is in many cases all that matters) yes, McCain and Obama did not follow the correct procedures to be placed on the presidential ballot in Texas. Obama would argue that this was not possible for him because he had not been officially nominated yet, and McCain would argue that this is unfair because he had not named his VP candidate yet.
By the letter of the law, I feel Bob Barr has a point, but I can't really see the two main parties standing back and taking this lying down (especially the Reps, considering Texas is basically guaranteed electoral college votes for them).
Edit: Apparently Texas allows write-in candidates, so people will still be able to vote for McCain and Obama even if their names do not specifically appear on the printed ballot papers.
Response: I'm not saying that it's right that the Dems and Reps can just ignore Texas law, but when the two major parties go to the courts citing that it would be nonsensical for them to submit paperwork which did not name Obama/Biden or Palin on the ticket, I think we both know whose side the judge is most likely to vote in favour of. Even if McCain and Obama are kept off the ballot this time around, expect a law change pushing back the deadline for paperwork to after the Republican convention. Oh, and I agree - if Bob Barr had missed the deadline he would not be allowed on the ballot, as it was in W Virginia - I don't agree with the double standards, I'm just being a pragmatist here.

This is too good to be true. And even if it is, the Texas Constitution will be thrown out before the two major parties are excluded from the ballot over a technicality.

Not true otherwise they couldn't be on the ballots for the primaries.
