If they don't have a lease, a utility bill in their name or the residence on their driver's license, in most states they are trespassing and have no right to be there. Call the cops.

If you have a landlord tenant relationship with any of these people the terms of the tenancy will control. The key point is that even with a periodic tenancy, (Month to month) there is a recognized posessory interest in that part of the property that was contracted for. Now, that being said, if the tenant then breaches the agreement, your remedy is an unlawful detainer action which will have to be heard in the local superior court. You can give them notice to vacate, which under law has to be a period of time equal to the term of the tenancy.

As to the new people coming in, they are not parties to the agreement, if there is one, and as such they are probably trespassers and could be removed by law enforcement. Depending again on the terms of the tenancy.

If you call law enforcement on the new people your time to achieve results will be significantly shorter. If you give notice to the tenant, they may just leave, or they may not. If they choose not to go your remedy will be a writ of ejectment which you can get at the end of the unlawful detainer case, if you prevail. Legal actions, unfortunately do take time. How much time will depend on how crowded the docket is at the local Superior Court.

wait till they go out change the locks ASP . They are taking control of you and your home. Put your foot down and be firm. You can get a couple of BIG Strong friends to come and stay with you if you know someone like that. Don't let them get away with it. Don't let them stay any longer as I don't know how the law stands if they are there for a lengthly time. I presume they don't have a rent book and make sure they don't get any bills registered to your home in their name eg. like cell phone bills and so on.

    Good Luck.

First, tell them that they have to leave. Did you set up (even verbal) a time that they could stay? You never agreed to the daughter and friend so they can be kicked out immediately. You might have to give notice to the friend if you set up some kind of verbal contract.

If you didn't, tell her the others have to go right now. She will have 48 hours to get her things and go somewhere else. Make sure you protect yourself and your things though if things get out of hand. Get the police involved if you have to.

Go to the courthouse and get eviction paperwork and serve them! make sure you put on the eviction notice whatever her name is "and all other occupants"

people have been known to leave children behind because their names werent on the notice.

There are steps to take but the court can fill you in on exactly what needs to be done.

    Good luck

You are protected by law against tenants moving in that were not in the contract. But the law varies by region--what province and country do you reside in?

Fastest can only be 30 days, which they can drag out to 90 if you take them to court...
