What do I do about problems at work?

My former coworker has been my boss now for about a year. She constantly makes comments about my personal health issues and in October after a friend died she berated me the day after I attended his funeral for being a half hour late to work. We open at 8:30 and I get in at 8, That day I called and said I would be late and got in at 8;35. Well, to make a long story short--another coworkers birthday is this Friday and she's taking the day off. I've been in a lawsuit for the past year for a fender bender I had 2 years ago. I just found out this afternoon that I have to give my deposition on Friday morning. We have a small office with only 4 full time people including my boss. With myself and the other girl off on Friday that would leave one coworker by herself on a very busy day. My boss may not be available to help cover the front desk area with this other coworker. I'm afraid my boss is going to give me grief tomorrow about the deposition, but she's know about this coming since before Thanksgiving. My attorney told me the deposition would probably be around the 20th of december. I'm also planning to take the day off so I don't feel rushed through deposition. I told the coworker that will be here Friday that I was planning that and she could hardly look at me. And then just keep giving me these little straight lipped smiles saying okay, uh huh. I can't stand this. I feel like everyone is going to be upset.

    I would try to have an open conversation with your boss and ask her if she has issues with your performance and ask how you can improve. If attendance is an issue it will likely come up then. It may also be an opportunity to politely tell her you would rather keep your personal health issues from the rest of the staff.

    You classified this under Law & Legal. I don't see anything illegal going on from what you described. Talking about personal health could be a voilation of HIPPA, but if you have talked to others in the office about it (especially with only 4 people in the office) you pretty much lost your case.

    Having less than 15 employees, and employer is protected from the vast majority of discrimination claims.

    A frank, civil conversation is probably your best bet. Good luck!

    You've got a couple of things going on here. If you are uncomfortable with your boss making comments about your personal health, you need to politely and professionally ask that s/he refrain from making those comments. You can go to www.eeoc.gov and click on harassment to find out if what is happening is harassment.

    Regarding your schedule, because you are in a small office, it is likely that they depend on everyone to be at work, on time all the time and that it's frustrating when someone is out or late as it can cause others to not get their work done. That's just what a small office is about. You should be honest with your attorney in that you need as much notice as possible to be away from work, and you also need to let your employer know that you will come to them the second you know the exact date you need to be out for a court date. Reasonable people like to be made aware and are much more understanding if given time to manage these type of situations.
