My ex-husband wont give my daughter back.? What should I do?
I am a single mother of 3. I have a set of twins that are 10 mos. and a 6 year old daughter. The twins were diagnosed with RSV (a respiratory virus) and were kept in the hospital for 3 days. While they were there, I called my ex-husband to keep my daughter until they were released because they were in pretty bad condition. He kept her, but failed to take her to school last Friday...and now he is refusing to give her back to me. I have been trying to contact him all weekend. He sent me a text this morning saying I will see her Christmas afternoon...I have court documents that show I have full custody and that he has every other weekend visitation. How can I get my daughter back? I am sure she has asked about me, he wont let her call or anything...What should I do?
the court order states he gets every other weend, 1 week out of the summer, christmas afternoon until the day after christmas.

What is wrong with letting him keep her till Christmas afternoon? It is only 2 days away. It should also be in the divorce papers where he gets her part of the Christmas holidays. If he does not produce her Christmas afternoon, I would then call the police.

You call him and calmly tell him if the child is not returned to you, you will take legal steps to have him charged with a violation of court ordered visitation-it is called parental interference...and if kidnapping charges can be leveled you WILL do that as well, in fact call you local police dept and see if they can help.....showing up at his doorstep with the law might be an incentive. Do the Court documents also show that he has visitation this week (Christmas)? It's fairly common for parents to alternate holidays and if its his week than its his week (regardless if you gave him access to your daughter a week before..that would be your choice).
If it isn't his week than I guess you could call the police as other people have recommended (or a lawyer / the Courts).

Call the police - have your court papers in hand and go pick her up. Second call - to your lawyer prior to picking the child up...cover your bases. Tell him if he keeps it up - you'll go for an emergency custody injunction and he'll miss seeing the children until you get it resolved in court - sometime over the next month or two...

Do you know where she is at?
Call the police and press charges. Make sure you let them know you have full custody and the papers to prove it. They will go with you to get your daughter back...I know this is the case in Indiana anyways.

call the cops he can be arrested for kid napping he is in violation of court order. have the cops meet you there and have the court papers with you.
