Process to become legal? Ok I am married to an illegal immigrant. She came over when she was little. ?

Ok I am married to an "illegal immigrant". She came over when she was little we I love her got married have a baby and want to get her legal. I have plenty of money and just got a lawyer to send off all applications and documents to start the process. We will eventually have to go back so she can come back legally. We are paying all of the penalties. How long from this point will it take before we have to leave. Thanks and please be nice. I know there will be plenty of mean replies but I appreciate all your help.

    I see where you are coming from. This is actually something very common. If you are a citizen it should be faster for her to become legal specially if you guys have a baby that was born here. Now, you should probably contact your attorney to talk about these things because this process is very complicated and certain things apply. For example the state you guys live in, is she has a job, if you have a good paying job, bank accts, credit, if you are a citized, if there is a reason why she cant be in her country and the list keeps going with a million and one things to look at. It's better to get advice from your attorney than from all of us here on yahoo, unless they are immigration attorneys.

    Maybe. It is not that simple. There is an entire, complex system of steps that need to be taken. One needs to become a "legal" immigrant. One has to file to stay. Money, employment, the past, proof of legitimate marriage, proof of intention to stay, proper paperwork, etc. etc. All these things have to be provided. Even then there is a citizenship course and process that has to be followed. Ultimately an immigrant CAN become a citizen, but you can't just come here illegally, marry someone, and be a citizen. It is a very complicated process. Ultimately, as you word the question, I have to say the answer is a big NO.

    It can take months, even years. The system here is wicked and slow.

    If you have a lawyer however, he should be able to speed this process up, and you should be in her home country in a few monhts.

    If she came over when she was little, technically she should be fine. Like these days they can't force children back over the border and once they're adults they get to stay. I don't see why your wife has to leave now.

    Take her to ICE and declare her so that she can start the immigration process legally.

    I think if you marry and illegal immigrant, they become a citizen.

    Depends on her home country. It can take a month to years or not at all..

    Have her apply for a green card, then for a US citizenship!
