Another if you fall out a window question...?

If you fall out a window(accidentally) and you fall on a person with lets say a really pointy umbrella or another object that can impale you or potently kill you and you die by that object. Is the person who you fall on and get impaled by going to be charged with murder, manslaughter or wrongful death?

    I wouldn't think so. If you accidentally fall out of a window and a person just happens to be passing by with an umbrella or something, I don't think it would be either person's fault but then again that question doesn't come up often so it's tough ya know?

    They will probably charge murder (2nd degree where I love. Then plead it down to what it is, which is:

    involuntary manslaughter with mitigating circumstances

    Wrongful death is a civil claim which wouldn't apply. Negligence maybe, but there is no conscious act and no duty not to act, so probably out of luck on that.

    no he is not imprisoned as its ur mistake and there's nothing fault in him.so that's ur fault and fate.
