If you entered to this country legally with a visa and you overstayed, its ok. If you go to your country you will have problems waiting for your legal papers. My advice to you, is to get marry and have your GF (wife to be) after your marriage to due the petition for change of status due to marriage. Please do not go to your country and wait for the petition of your wife, this will take longer than you doing it in the US.

Emigration are very nice ppl as long you do the correct thing.... and are there to help you.(Normally they are very nice people)

Good luck to you and just be honest to all the questions and papers you will Summit after your marriage. Good luck to you.

What is a cwop visa? If you marry and you did not enter unlawfully, or

in transit without visa or as a crew member, your wife can submit an

immigrant visa petition (Form . I-130). Concurrently you can submit

an application for adjustment of status (I-485). See the USCIS web site for the forms and procedure. If you are ineligible for adjustment

of status, the approved visa pettion will be sent to an american consulate in Mexico where you would apply for an immigrant visa.
