How to get my fiancee into the US?

We met online. We're both mathematicians. She's visited here several times. We 'fit' together well (interpret that how you will ☺). What's the best way (legally) for her to come here permanently?

Update:

I guess I should also add that I'm currently between jobs and in the process of getting divorced.

Update 2:

Would it be easier (and quicker) to just wait until the divorce is final and then just have her come here and we get married? Or would she get deported for some period of time? Or what?

    The easiest way is for you to get divorced, and have your new fiancee come over on a tourist visa (B-1/B-2) and get married while she is in the US. The fiancee visa takes a while and would be my second option if she could not get a B1/B2 visa first.

    Several years ago I spoke to an local immigration office manager in our city about this subject. In my case I was trying to get married officially overseas, and then bring her back over after the wedding. She came over on a student visa and extended her stay after we got engaged knowing that we would get married some day. Immigration at that time did not frown on our relationship, but she was paying taxes at the time, and basically living like a resident. She could have been (before marriage) deported if they found her. We eventually got married but I don't know the situation you are in exactly.

    Hi Doug,

    I came here from another country, therefore I understand your problem. I know that immigration law is not easy, but I was studying law, and can share with you what I know about it. Right now it is only one possibility (in your situation) to bring your fiancee here permanently - by marriage. You can bring her here now, but she will still has to wait until your divorce will be finalized. She should be alright for the period of her visa. You can also call U.S. Ambassy and ask; they should provide you with the best information. Good luck to both of you!

    When you divorce is final, you file I-129F, I-864 and G-325A with the USCIS. Be sure to include all the required evidence of your relationship. Depending on what country she's from it can take from 12 to 24 months for her to get a fiancee visa.

    Once he arrives in the USA you have 90 days to get married. After the marriage she needs to file I-485, I-131 and I-765.

    She'll get a work permit in about 60 to 90 days and have her Green Card interview in 6 to 8 months.

    ************She cannot enter the USA with a tourist visa, or on the Visa Waiver Program, for the purpose of marriage. She will be refused entry at the port of entry. To get in she'd have to lie, that's fraud. Take my word for it, getting investigated for visa fraud isn't the way to start off a marriage. Do it the right way.

    2 of K1 Fiance visa requirements are you have met face to face within the last 2 years and you both must be free to marry. In other words, your divorce must be finalized to be able to file the petition.

    File a fiancee petition (form I-129F) with immigration for a fiancee visa.

    See uscis.gov for the form , info and instructions.

    Sorry, you cannot file the fiancee petition until you

    are free to marry.
