Can someone help me understand the meaning of this?
I'm writing an essay about Guantanamo Bay. This is from an article from a very reliable database. Can you help me understand what this is saying?
"First, granting enemy combatants the same constitutional rights as U.S. citizens places an extremely high burden of proof on the United States, while affording alleged terrorists expansive discovery privileges.
**These privileges may include the right to call witnesses at trial--such as CIA agents, military personnel, and Department of Defense officials. Empowering alleged terrorists to summon these officers from the front lines to appear in court might impede our ability to prevent another attack."
**What does it mean by "the right to call witnesses at trial"? Any information would help me out tremendously. I don't think I should provide the link because it requires that I give you my school's password to the database.
ah, yeah, I was really close to posting it in Law and Ethics. this was my first stop though.
I understand the part about the defendant can call any witness to trial. But how would an accused terrorist use a military official as a witness? To prove that there has been torture, right? That's my next biggest question. What would they try to accomplish by bringing officials as witnesses? Please feel free to edit your answer and add this. Thanks!!!!

The defendant (or their attorney) has the right to call anyone who could have been connected to the case to testify in court.
It is usually done in an effort by the defense to show that the law was violated when the suspect was originally detained or charged with a crime.
To me, the argument set forth by the Bush Admin. that it would endanger witnesses or impede our ability to capture terrorists is a cop-out.
They know that if certain witnesses are called by the defense, that it will quickly become apparent that most of the defendants were tortured to gain information about other terrorist activities and thus since torture is illegal by US law, the judge will have no choice but to set the defendant free.

well the accused would be allowed to ask a witness to give his/her story in order to defend the accused this could be a friend or colleague tho witnesses could also be the arresting officer if the terrorist was caught by a soldier unit the accused can call the units commanding officer to give evidence

The basic answer is that you can call any witness you feel would support your case whether you are the prosecutor or the defendant.

In an American trial, the defense gets to call witnesses. They have to have something to do with the case, but it can be anyone.
So, an accused terrorist going to trial could call CIA agents who worked on capturing him to trial, compromising them and thier techniques (since trials are more or less public).

One of the fundamental principals of the American justice system is the right of the accused to confront their accuser. That is if someone alleges that you did something you have the right to have that person do it physically and in open court. What this article is saying is that it is impractical to have a front line Soldier that saw the alleged act be forced to take time out of his/her deployment to answer the summons.

well i think if i can remember it right basically your right in a trial is that you can call on any witness you want and as many as you want
