In Alabama, if you do not have insurance and get in an accident, will it automatically be your fault?
I was recently involved in a car accident. The other driver was on the phone and it was raining. Can you be placed at fault because of the fact you had no insurance?

No, having no insurance does not automatically make the accident your fault.
Being responsible for an accident and not having insurance are two separate issues.

It will probably turn out to be your fault, I don't know that for sure but strange things do happen.
My daughter ran a stop sign and was broadsided by another car which had the right of way.(didn't have a stop sign) When the cops came, they gave the girl that had the right of way a ticket. And they"didn't" give my daughter a ticket for running the stop sign. It turned out that the other drivers license plates and inspection sticker both had expired, they said had her car been where it belonged, which was parked in her driveway the accident wouldn't have happened. The other drivers insurance also had to replace my daughters car as it was totaled.
And I was also totally surprised at the outcome myself.

You can of course be cited for no insurance, but not having insurance does not immediately put you at fault.
