Any change to the tax code has to be brought up in the House as a bill, passed and sent to the Senate. If passed there it then needs the Presidents signature . If he veto's, it needs 2/3 vote of House and Senate to pass.

SIN taxes are easy to get through as it only singles out certain actions or classes of citizens.

What happened here is the Prez set up a means of support for the S chip health program and the Democratic House came up with a means to fund it.
