Hypothetical question on gun confiscation?

Suppose, just suppose, that Congress passed and Obama signed legislation outlawing all firearms and that all guns had to be turned in to local law enforcement within 24 hours under penalty of death. Suppose you are the owner of six handguns, six shotguns and six rifles.

The question is this: How many of your 18 firearms would you deliver to the government?

    Hypothetical answer: First of all this would mean that the rest of the constitution is out the window too. I'm going to guess it would be after every body's on board with a (global citizen) program.They would give thirty days to turn in your weapons with some compensation.They would use police (world police) to enforce this, wearing masks of course so you can't see they are not from this country, why? because being they are not fellow citizens they have no hesitation to blast you if you not comply.Then when you have turned over your weapons , you have to sign a form and from all this they would determine if you are a threat and if so they would come for you in the middle of the night and put a black bag over your head and take you away to a FEMA death camp and that would be the end of you.......Hypothetically of course..........

    What if the world blew up tomorrow?

    Outside of the second amendment, there is also the 5th that prevents this from happening (the 5th isn't only about self incrimination). The government is not allowed to seize your property without fair compensation.

    For example if the government wants to build a highway through my property, they can legally force me to sell it, but they have to pay me fair market value.

    The same would be true of guns. If you outlaw it and force me to sell it to the government, you have to fairly compensate me for it.

    You also can't seize my property without due process of law. Also, how would you know that I have a gun? You would have to get a judge to sign a search warrant. To get that search warrant signed you would need to provide probable cause. You can't just kick somebody's door in and take their stuff, even of you're working for Uncle Sam. Also, outlawing guns entirely would go against the second A.

    Then there's the almighty dollar. Enforcing that kind of law is cost prohibitive. We're already in enough economic trouble as is.

    Next you have to consider that federal government can execute you only for a very few select crimes (treason, capital crimes committed while in the military, etc). Also, owning contraband anything is not punishable by death in any state. Heck you can get away with life in prison for kiddie rape in states that have the death penalty.

    But, to answer your question. I would use those 24 hours to pack up and move to another country.

    I wouldn't. There would be hell on earth just trying to create such a law. And besides, once you surrender your firearms, you are dead anyway. Just look at any country that has outlawed guns. You loose all your liberties "for your own good" they say.

    Maybe to ease your mind a little. With so many firearms, I would give them 3 shotguns.

    I couldn't answer that today. I would need more details, like, does this involve the taking of a mark.

    Lovinglife-- I know of several situations where the land owner would not accept the "fair market value" and a Municipal Govt. condemned and took land, proving in court that the land was not safe to occupy. ie- if a road was going in, then it wouldn't be safe for you to stand or build a house in the middle of it huh?

    You are not going to believe this but all 18 of my guns were stolen the day before this legislation passed.

    Seriously though, I would not give up any gun to anybody no matter what the circumstances.

    none. i'd sue the federal government (assuming the NRA didn't beat me to it). i'd have pretty damn good constitutional grounds, too (See Amendments 2, 4, 5, 6, 8, 10, and 14 for starters).

    the judge would then sign an injunction preventing the law from being enforceable. it would go to the SCOTUS, who would strike down the law for good.

    and then I would proceed to run for president as the one man who protected your Constitutional rights. :-)

    That legislation would be unconstitutional, and therefore void. Most law enforcement would ignore that law.

    the respond from seven-hundred Nitro is actual and the concern replaced into uncovered in diverse classes and articles, plus via the internet. the respond from The Deadliest Mushroom is misguided. the element replaced into that the defense force (in particular) and a few police confiscated firearms from people who have been helping via securing their very very own neighborhoods against the looters. normally, voters in unflooded aspects have been forcibly disarmed via the defense force, who then left the voters to the "mercy" of the criminals roaming the city interior the 1st few days after Katrina struck. regulation abiding voters of their very very own properties have been illegally & unconstitutionally disarmed on the orders of Democrat politicians.
