How likely is it that this person is here legally?

I was told that a person is here legally. He came w/ his wife & children in 2000 from Mexico. He has no degree and works in a restaurant. He has no other family in the area.

He's a nice guy, but I think the odds are against him having legal status.

What are the odds that he got an immigration visa?

Not good. He may have entered legally on a visa--that's a possibility, although if he's not especially educated, it's doubtful he got one of those. (Lots of professionals are fleeing Mexico now using visas, but I doubt they're working in a restaurant unless they own it.) Mexicans aren't eligible for a diversity visa. Is it possible he has a U.S. citizen family member who sponsored the family? That can take years and the sponsor doesn't necessarily have to be in the area. An Indian woman I knew was sponsored by her doctor brother but it took so long to get a visa that he had moved to another state by the time she and her family came.

the odds are high, if he came here with his whole family(wife and children)

and only has a restaurant job? no family? there is a good cue, usually when one comes to the US? either he has a girlfriend, wife, job offer, study,

but none of the above? he probably is illegal.

The odds are good. There are millions upon millions of Mexicans who came here legally.

The odds are he is unless one has concrete factual evidence he isn't. Not sure why that would be the business of anyone else.

Hard to say - I wouldn't eat in that restaurant tho. Have you heard about those parasitic worms they are bringing into this country?

If you are looking to employ him you can check his status using E-Verify

If he is collecting medicaid, or other taxpayer funded benefit you should report him.

Very good, now leave him alone. If he's not causing any trouble then it's none of your business.
