Can someone help identify this plant?(pics)?

This plant is growing up around my tree.Last year I tried to dig it up by the roots,but after digging over a foot deep,I gave up and just cut them at the surface of the soil.Can someone please identify it for me and give clues as to how to get rid of it?It's literally growing right up against it and I never actually got to the roots(which seemed strange),but does not resemble the tree at all.Thanks in advance!

    It still may be a sucker from the main tree. My neighbor has a plum tree and I get the suckers in my yard that look nothing like the plum tree itself.

    Datuk ok balik Pulau Ketam ... he gave up YAM cuz Crab went lower back to Pulau Ketam with out informing him ... undesirable element .... hopefully they're going to stay fortuitously ever after in Pulau Ketam ... i'm a transfomed via Baen touch ... like Agent Smith interior the Matrix, changng human beings io him ... lol

    flowering quince. the stipules give it away. pretty flowers in early spring, if you want to move it. otherwise, roundup it
