Do I have a case? If so how do I file a formal complaint against the law firm?
I am a single mother and a full time student and I have lived at home with my parents since birth. A few months back I received a wage garnishment from my employer. It stated that I owed rent on an apartment that I never rented. I know that my identity was stolen and by a family member. So when I called the law office and spoke to someone about what was happening of course the person made it sound like I helped this family member to get this apartment and this family member basically threw me under the bus, and that is not the case. I have called this firm a few times and requested some things from them and never heard word back. I am currently writing them a letter stating my case and also requesting the same items that I did before but I would like to know if I have a case against them and what for exactly?

It would be best if you could get a lawyer who may be able to represent you on a contingency basis. You could and probably should sue the person(s) who stole your identity to make you liable for their own financial obligation and also sue the person(s) who falsely accused you of not paying a bill for which you had no obligation to pay and then distorted your statements to seem otherwise. Your damages include the amount that were improperly garnished from your wages, lowered credit score and your legal fees for having to assert your rights which were basically stolen from you. There may be actions in conversion, fraud, theft, misrepresentation and possibly defamation. You need to talk to a lawyer to put this together. You may be able to file a professional conduct complaint against the lawyer with the appropriate state board but that's not going to put you back in the same financial position you were in beforehand.

What? I am so confused. A family member stole your identity. That I got. I don't understand what your problem with the law firm is. Go to the cops and file a report/complaint about your family member.

If you wish to make a complaint against a law firm then the right place is the Law Society. Find out their phone number because they regulate the legal profession. They will tell you the procedure.

How do you get garnished without a hearing. Could they prove you signed a lease contract. Can they tie you to any of the business at hand.
Don't see how they garnished your pay that easy.
