Debt Collection Question - Car under both our name but not married. Is it exempt?
Then there is the issue of our joint bank account.
And the issue of household items since a large majority of them are mine and not his.
My boyfriend (of 8 years) is currently being taken to court for a debt. They will likely win. I understand that once they do they can repossess household items etc.. including your car if it over a certain value. Well here is my question. For our car we are both on the agreement to purchase it. I am the primary person on the agreement, they send the bills to my name, but his name is on there as well. How would this work in terms of them repossessing?? Do they have a right to the car if my name is on it as well and I'm not in trouble with them???

With a few excepts they will garnish his wages as a first measure then clean out the checking account if it is a jointly held account. They they might lien some properties.

The car is not paid off, therefore, they cannot take it. What type of debt is he being sued for? If it is credit card debt, or a medical debt, those two are unsecured debts and they cannot summarily just come to your house after they get a judgment and pick through your stuff to sell on Ebay! LOL UNLESS, the debt was secured by some item you both own, his wages would be the first thing they would try to attach and his bank account. They want his CASH, not his second hand goods!

Don't worry if he looses and they get a judgment they will garnish his wages first then they will attach your joint bank account only after that will they file liens on property.
They can't take your car, they can file a lien on it which will keep you from selling it until you pay the lien off. They can not take household item either.
If I were you I would close that joint account and open separate accounts or you could lose all of your money.
