Dispute between Agent and Landlord - Agent witholding deposit!?
Hi all,
I am renting a house that my family and I want to stay in, the landlord has had a dispute with the agent and has just changed agents but he has assured me that it will not affect me - however the old agent is refusing to pay back the deposit until the landlord settles a disputed amount - can they do that?? The deposit was paid to the agent, not the landlord and was with the Tenancy Deposit Scheme - can they do this to me????

The landlord has confirmed that the Agent received the deposit - he never received a penny of it - does this make a difference?? I like the landlord, he is a nice bloke and he is as annoyed at this as I am and I dont want to strain the so far good relationship I have with him..

Yes, they can. Your deposit will not be returned to you until you leave. It is the owner's responsibility to get any deposits owed to him before he terminates the agent's agreement. Just make sure with your owner that he gets it back. It won't be returned to you, but the new agent will be responsible.

If the deposit is as you say protected by the TDS then you and your landlord are completely protected. The agent will not be able to retain the deposit and if it has been put into the custodial scheme the agent will not actually have it anyway. But you will not see your deposit until your tenancy ends.

The deposit is help by the tds and both the tenant and the agent/landlord have to agree before any deductions are made. you should have the details of the scheme, ring them and ask how the situation effects you. This will put your mind at rest. The agent is being an ****.

The old agent represented the landlord at the time you paid the money so the dispute is between them and has nothing to do with you. When you are entitled to the refund the landlord ultimately owes you the money.

This is the landlords problem, not yours. He still has to refund your deposit when you leave, you paid the agent he hired in good faith. This dispute has nothing to do with you and your rights to the deposit from the landlord.

To get it resolved right now, i could deliver the agent a Self Addressed Stamped Envelope made out on your return handle. definite it could cost a sprint you 88 cents, yet a minimum of you get your deposit.
