Will the "Birthers" give up now and accept Obama as a citizen?

Now that yet another judge has thrown this case out, will the birthers give up the crazy claim that Obama wasn't born in Hawaii?

I even have a quote and a link:

U.S. District Court Judge Clay Land tossed out on Wednesday a complaint by an Army captain fighting deployment to Iraq by questioning the legitimacy of President Barack Obama.

Land also put attorney Orly Taitz, who represents Capt. Connie Rhodes and is a leader in the national “birther” movement, on notice by stating that she could face sanctions if she ever again files in his court a similar “frivolous” lawsuit — a document that at one point the judge states that a middle school student could find irony in.

“(Rhodes) has presented no credible evidence and has made no reliable factual allegations to support her unsubstantiated, conclusory allegations and conjecture that President Obama is ineligible to serve as president of the United States,” Land states in his order. “Instead, she uses her complaint as a platform for spouting political rhetoric, such as her claims that the president is ‘an illegal usurper, an unlawful pretender, [and] an unqualified imposter.’”

Update:

Liberals keep bringing it up? This latest lawsuit was just settled. How could you say we have been bringing it up all year?

Nothing will make them stop. It's now become a conspiracy theory, and the moving goalpost principle applies. They persist even when Ann Coulter calls them hacks. Even if he releases his birth certificate again, people will still claim it was forged. He could produce originals of any document ever associated with him, and they'll be called fakes. Unless they invent a time machine and ship all of the birthers back to the moment of his birth and they witness it themselves, as well as get DNA evidence that the people involved are who they say they are (specifically Obama and his mother), they might abate. Might. Until then, it will always be a delusion held in the minds of the paranoid and bored.

Oh, and every president has to go through security screenings by NSA to get the Gold Codes. The first thing they do is check citizenship. I doubt they'd take his word for it before giving him the launch codes to every nuclear weapon our country has.

It's hopeless, they are delusional. There's no other explanation for this spin:

"The case is highly highly significant — actually a giant step forward — because IT IS THE FIRST EVER TO DISCUSS THE MERITS OF THE FACTS BEHIND THE OBAMA ELIGIBILITY ISSUE — YET NO DISCOVERY!!!!!

Based on this case, where the Court has elected to discuss the merits of the facts of Obama eligibility, the Court denies the TRO saying that those facts are not likely to show Obama ineligibility. Since the FACTS HAVE NOW BEEN RAISED — IN AN ACTUAL CASE — THE NEXT STEP IS DISCOVERY BASED ON THOSE FACTS. Judge Land has done a great favor and service by OPENING THE DOOR TO THE FACTS SURROUNDING OBAMA ELIGIBILITY AS AN ISSUE.

Don’t be fooled; sure Judge Land appeared to come down very hard on Taitz — but again by saying the facts case is frivoulous, without any discovery allowed bearing on those facts — Judge Land moves the cases forward!!!!! (yet protecting himself from the Obamabots)"

"In his order, Land states in a footnote that Obama defeated seven opponents in a “grueling” primary campaign that cost the contenders more than $300 million. Obama then moved on to the general election, where he faced Sen. John McCain, who Land states got $84 million to wage his campaign.

“It would appear that ample opportunity existed for discovery of evidence that would support any contention that the president was not eligible for the office he sought,” Land says.

The judge adds that Congress hasn’t started impeachment proceedings against Obama, appears satisfied that he can hold the office and has rejected the suggestion he isn’t."

None of which has ANYTHING TO do with the legal argument.

No one else asked so that must mean that he is , that is the judgement of the judge?

And all the frivilous lawsuits I have heard about that judges have let go ahead and this one is so bad that the judge needs to threaten the ;lawyer??

The funny thing here is that Obama really isn't eligible to serve as President of the United States, but not for the reasons they state.

Yes, he was born in Hawaii, and is a native citizen of the US, but he isn't a "natural born citizen" as required by the Constitution of the US.

You see, a "natural born citizen" is a native citizen that has two US citizen parents. The founders wanted any President to have allegiance and loyalty exclusively to the US, so that meant that the person could have *only* US citizenship at birth.

According to Obama's "Fight the Smears" website http://www.fightthesmears.com/articles/5/birthcert... , it states that Obama is a "native citizen" and that his citizenship status was governed by The British Nationality Act of 1948. He was born with Kenyan/British and US citizenship. He isn't a natural born citizen.

You may say that there is no definition of "natural born citizen"? How about these:

Vattel's Law of Nations was extensively consulted during the writing of the Constitution according to Benjamin Franklin http://etext.lib.virginia.edu/etcbin/toccer-new2?i... The "Law of Nations" stated, "...natural-born citizens, are those born in the country, of parents who are citizens..."

Also, the definition is confirmed by Senator John A. Bingham who co-authored the part of the 14th amendment that concerns citizenship. He said, "[I] find no fault with the introductory clause [S 61 Bill], which is simply declaratory of what is written in the Constitution, that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen…. . . "

    - John Bingham in the United States House on March 9, 1866 (Cong. Globe, 39th, 1st Sess., 1291 (1866))

Supreme Court cases support the definition of a "natural born citizen" being a person born to two US citizens on US soil.

    U.S. v. Wong Kim Ark, 169 U.S. 649 (1898) http://supreme.justia.com/us/169/649/case.html

    Perkins v. Elg 307 U.S. 325 (1939) http://caselaw.lp.findlaw.com/scripts/getcase.pl?c...

    Kwock Jan Fat v. White, 253 U.S. 454 (1920) http://supreme.justia.com/us/253/454/case.html

At Birth, Barack Obama had dual citizenship, British/Kenyan and American.

Simply put, Obama isn't a "natural-born citizen" and isn't constitutionally qualified to be President.

I don't care if a hundred courts rule a particular way.

While I don't necessarily believe he is a non-citizen, if there's nothing to hide, why does he steadfastly refuse to release his actual birth certificate? Rather than calling people with whom you disagree crazy, wouldn't it be simpler and more effective to release the damned thing?

  • 1 decade ago

I have no opinion either way but I do find it very curious that his full birth certificate has not been released. He refuses and I can only wonder why.
