It is ILLEGAL to pass on the Berm of a the road, EVEN WHEN THE DRIVER IS TURNING LEFT. It is illegal to cross ANY solid line to pass. That's why they are SOLID. I hate when people who don't know the rules claim they do and claim that illegal acts are fine/legal. If you cross someone on the berm of the road you CAN be cited for Driving in a lane not designated for driving(or something like that). Just because people DO it doesn't mean it is legal. People run red lights and stop signs, that doesn't make it legal.

It is defintetely legal as long as you have a broken yellow line. I have passed a few cars at a time before on a broken yellow line. It is of course illegal to speed, but you know that. As long as you stay around the speed limit, and it's a broken yellow line on your side, then you can pass as many cars as you want at a time.

Not where I live. (NH, USA)

Source(s): +1 sgoldperson. The ONLY time passing on the right is legal is if there is a full lane available to use. Cross the line = break the law.
