Are children considered 'persons' for a carpool lane in CA?

Everyday I drive to work in a HOV lane in California. I drive a van that has me and two of my kids, ages 1 and 3. I have looked for a definition to what qualifies as a 'person' for a carpool lane, but I have not found any. Given that, I have been assuming that I have three 'persons' in the car, therefore I can use the lane.

But since this *is* California, I wanted to make sure there was no obscure definition for 'persons' when using the carpool lane. Any insights?

Hope this help you ...I get this from CHP-frequently asked questions of the highway patrol

Source(s): I'm pregnant. The HOV lane requires two persons in a vehicle. Now that I'm eating for two, can I use this lane? California law requires that in order to utilize the HOV lane, there must be two (or, if posted, three) separate individuals occupying seats in a vehicle. Until your "passenger" is capable of riding in his or her own seat, you cannot count them.

Even a new born is legal as a second person. AND, NO. Pregnant women are not two persons. AND, NO. A mortician cannot drive in the carpool lane with a dead body.

Yes, any person of any age counts as a person for purposes of using the carpool lane in California.

A pregnant woman does not count as 2 people, and a funeral casket with a body in it does not count as a person.
