Help with legal advice on how I keep my friend from being homeless.?
Your Open QuestionShow me another »
My friend will be homeless soon! Please help me.?
Here is the situation. My landlord is selling the land we are on to a homeowners association. My good friend recently started staying with me because she left her abusive husband and she and her one year old are here. The landlord and the assoc say no one can live here anymore unless they own the house. And they will not let me make her part owner since she is not family. Unless I can somehow fight this she will be homeless in two weeks in October in Montana. We already have snow on the ground not to mention how wrong it is to let this happen. Is there a way to FIGHT?!
I invited her to stay with me her family lives out of state. Way to have a heart. Sponging off me?? I opened my home to her since we are both single moms who are going through a rough time right now. And the association having "rules for this reason" what reason is that? So people who are causing no trouble for anyone, who pay their fees on time every month have no say in who can live in their own home? Yeah, it's really fair. I will just tell my dear friend to hit the road. I mean it's her fault for marrying an abusive alcoholic right?

Can you fight on the basis that she's a domestic partner (and I don't mean it's a romantic relationship)? I would simply refuse to move and if they continue start seeing an attorney basing the argument you two are domestic partners raising your children together, working as a unit.

The reason your homeowner assocation has rules is for this reason. Tell her to call her parents or relatives and explain the situation. I think it is very unfair of her to sponge off you because you are her friend. This is something that she should have discussed with her relatives and not you. There is no way to fight. Tell her to call her parents tonight and have them figure out an answer. If you don't, you may risk getting kicked out or sued.

If the rules of the home owners association are as you state, there really isn't any way for you to fight it.
Her best option is to go to a shelter. They will help her in every way possible to get on her feet and get a place of her own. I know it isn't the ideal situation, but they really do help.
