I was laid off a week ago and it appears the company has replaced me with the boss' wife?

I live in California - it is my understanding that you can't be laid off and immediately replaced with someone else. I am not 100% positive they are paying her (since she is an owner, I guess she could be working for free) but the other owner's wife works for the company and she makes more than a reasonable salary for what she does.(she's in accounting and makes $150K a year.) I was NEVER told that it was a performance issue and in fact always received excellent performance reviews and got big raises every year (10-15%). I was told I was being laid off because of money issues, and my duties would be redistributed amongst existing employees...but no more than a week goes by and the boss' wife is sitting in my old office??

Update:

to the person suggesting I get in the unemployment line - you must not have ever collected unemployment. I'll be getting $450 a week...compared to the $1700 a week I was making. So yes, it is a big difference. I can't support my family on that. I can't pay my mortgage with that. And in case you haven't noticed, jobs are scarce. I worked at that place for over a decade. I just want my old job back.

    It used to be What You Know (and company loyalty. Companies looked out for its' employees).

    Now it's Who You Know, and there's plenty of that going around.

    Company loyalty went out with black & white tv's. Unless you're union, you're only as good for as long as the company needs you-for their advantage. When you're "no longer vital" for that company, i.e. someone's relative needs a job - you're on your way to the Unemployment office.

    I've seen people with senority and years of experience, get rolled over by people were friendly with, did favors for, or were related to someone in HR. Those "walk-ins" got promos also.

    Sorry this happened to you - it's annoying - but look at it this way also: you've gotten excellent performance reviews, that counts. Unfortunately you're leaving behind coworkers who'll end up with double the workload.

    I don't know Cali law, so I honestly don't know if you've go a legal leg to stand on. You're probably considered as an "At-will' = laid off, or fired at any time, no reason given.

    If you were replaced by the bosses' wife, she probably is not getting paid. If she is, I'm sure it's way less than you were making. You have no recourse here and you won't get your old job back. An employer can get rid of a person at any time, for many reasons. Go get the unemployment while you are job seeking. It is better than no income at all. You should have a bit to collect after working so many years. I know you feel let down but don't dwell on it. You don't have time, you have bills to pay.

    accomplish that on condition which you're receiving severance from the corporate that's being paid out to you weekly or although your organization pays workers, yet not while you at the instant are receiving unemployment. Your job job at the instant are not from now on your difficulty and you are able to not provide your wisdom away for loose to a company who laid you off and altered you with a lesser experienced individual.

    Laid off? Get to the unemployment line fast. Don't fret about what is going on at the place that let you down. Take the employer to the bank by getting on unemployment. If you have been with them for more than 2 quarters, then you got the company by the b*lls.

    Sounds like you got your first lesson in nepotism.......sorry.......suck it up and move on......rough in the real world.......consider this.......she probably likes it less then you do......times are rough......companies must do what they have to.......
