Can I file my taxes as a married man if I marry before the new year?

I'm pretty sure the IRS doesn't count days, so if I get married on Dec. 30, can I file my taxes as a married man in 2009?

Yes. You can and MUST file as married if you are married when the year ends. It is illegal to file as single if you are not single when the year ends.

If you are married as of the end of the year, you not only can but must file your return as married. What counts is your status as of the end of Dec. 31

    Can you? You MUST!

Your marital status at the stroke of midnight on Dec 31st determines your filing status for the entire year.

Yes. You can and you must. Your marital status as of December 31 is what determines your filing status.
