Why is it when a doctor?

performs an abortion it not murder, but when a person kills a pregnant woman, that person is charged with a double murder? What is the difference?

    It's sad isn't it? Doctors took an oath to save lives but instead they take the lives of millions of unborn children. Abortion is murder too. Unborn children are human too.

    -- HOW ABSURD --

    If killing a pregnant woman and causing the fetus to die does indeed constitute a double murder then this is a ridiculous law.

    What if the woman was pregnant with quadruplets? Is it now a multiple homicide; is the killer a mass murderer? Oh, shut up.

    And what if the killer called an ambulance just after the stabbing and tried to save the woman. Is the death of the fetus now involuntary manslaughter?

    What if the woman was giving birth right at the moment of the attack and the attacker called an ambulance? The baby is half way out but it dies. Can we reduce the charge for the baby’s death to negligent homicide?

    Do you get it; this entire conversation is ridiculous.

    Such charges should only apply to the act of killing a person who has been born.

    You can’t commit an attack on something that is forming inside somebody’s body.

    Similarly, if the parents had life insurance on the child should the husband now receive $100,000 from the insurer for losing “his child”? How absurd is this argument?

    What if I win a prize for catching the biggest fish in a contest and then it turns out that it was a pregnant fish? Should I be disqualified and lose the 1st prize money because it wasn’t actually one fish?

    The woman is given the choice as she is put before the fetus, it may seem like murder and it may very well be murder but you can't force things upon people. It's all about their right to choose what they do with their own bodies and what they are willing to go through. The fetus is not fully developed and is not recognizable as a child and so is treated that way.

    In my personal opinion abortion should only be available for people underage, victims of abuse or rape, women with serious health problems and women who are in an unsuitable environment to bring a child up. Other than that, i think women who become pregnant should seriously consider keeping the child, but then again it should NOT be forced.

    The woman being murdered may have wanted the child. And when someone is aborting a fetus, it is usually not wanted for one reason or another.

    Depending on what stage of pregnancy the mother was in, the baby probably was not a fully developed human anyway. In a way, its kind of a problem with our legal system. Is it right to charge a murderer with double murder if the baby is at the same stage as allowed for another fetus to be aborted?

    To be honest, this should be in the legal section.

    It's a question of choice, once again.

    When the mother has an abortion, it is her CHOICE.

    When a person kills a pregnant woman, he is charged with a double murder because he made the choice for the mother and also for her own life.

    Really very simple....

    Because in the murder case, the murder was not consensual.

    Give me all the thumbs down you want, but abortion is basically consensual murder.

    It is a major double standard in our judicial system that a man can go to jail for assaulting a pregnant woman if it results in her having a miscarriage while a licensed physician can basically do the same thing ... and get paid for it.

    I am by no means stating that someone who assaults or murders a pregnant woman should not go to jail for the crime of killing an unborn child, but I am stating that we should reexamine our beliefs.

    The difference is that when a woman chooses to have an abortion it IS her choice.

    When a pregnant woman is murdered it is NOT.

    The woman was carrying the baby in hopes of it being born, by killing her and the fetus it can be considered a double murder. When she wants it to happen she has the right to choose to end the fetus life.

    Its about the willingness of the woman basically

    The difference is the pregnant woman didn't want to die, whereas the fetus didn't really care.

    Correction: I agree abortion is bad, but it's not as bad as murder.

    There is no difference. There may be extenuating circumstances. We may quibble over an abortion performed to save the mother's life, for example. It is hard to make the law conform to the fact. If killing a fetus when killing the mother is a second charge of murder then, logically, killing the fetus alone should be murder.
