child support and social security payments to custodial parent?

My spouse's kid's mother gets his social security(300+month) and is requiring him to also pay her (260.00) in child support. Is she double dipping? Texas.

Update:

she gets social security (for the girl 15) because my spouse had cancer and is partially disabled. We feel that she wants money to support the girl and her 6 mo. old baby

    Bottom line, what does the court order say. If the court order says he has to pay in the amount of $560 a month, then that is what he has to pay. Typically for one child you pay about 20% of your gross pay. If his Gross pay is no where near $2800 a month, or 34K a year then something is horrible out of whack and needs to be addressed pronto.

    If there is no court order personally I would wait until there was one. Did you know that 30% of the men paying for child support in this country are paying for a child that is not biologically theirs?
