HB1 Visa Application fees reimbursed?

If I apply for HB1 visa, pay the $2000+ in fees, and they reach the quota and do not get application in, do i get the paid fees back? this in not in the case of denial, just not getting in under the quota for each year. Do they take the application fees even if they dont review my visa?

    If they have closed the visa availibility ..you lawyer will get back all the fees and paperwork

    You should not be paying any fees

    It must becoming near full any day now ... you can refile on April 1st for an Oct start

    If the petition is accepted for adjudcation by CIS, you would not receive a refund. They will accept the application and cash the check/money order. You would receive a decision such as denied or approved.

    If the petition is rejected (sent back to you untouched) by CIS for any reason, they will not cash the check/money order.

    As far as lawyer's fees are concerned, that has nothing to do with Citizenship & Immigration Services policy and procedure.

    If your application is not picked, USCIS will return everything including the check for fee that you included. The fee will only get cahsed when your application is picked to process.

    The government doesn't do refunds. You'll have to decide if it's worth the risk.
