Last Name Child Question?

My brother and his girlfriend are about to have a child and they are unmarried but are together. Since they aren't married could the mother still give the child my brothers last name or would it have to keep hers?

    She can give the child any name she wants even if it is completely different. Oh lets say if her last name was smith, and his last name was jones, she could, if she was so inclined, give her child the last name smones, ha ha doesn't have to be either parents last name.

    It depends on what the parents want for the child. Although, hyphenating the child's last name to have both last names of the parents is suitable idea.

    my sister had a baby and gave the baby the guys last name.. he didnt sign the birth certificate and the child still has his last name.. so i say maybe depending on the state ur in.. we're n florida

    His girlfriend can give the child whatever name she desires, your brother's opinion legally means nothing.

    That would depend on the state; however, in my state, as long as your brother assumes responsibility for the child it can have his last name.

    She can give the child whichever name she wants. He will have to sign the birth certificate if she gives the baby his name.

    They can give the baby whichever last name they want... they could name it Jingleheimerschmidt if they wished.

    it can go either way..whatever is put down on the birth record is what will be recorded
