Can my boyfriend claim the EIC tax credit?
My boyfriend and I live together. I had a baby in Sept. 2009. I am claiming her as a dependent, but can he get the EIC because he provides half of her support during the year, and pays for half of the household expenses?

No, he can not. If he's not the child's father he cannot claim the child or the EIC at all. The support that he pays is irrelevant. Only the parent that claims the child (if the child lived with the parent) can claim the EIC.
If he is the child's father then either of you can claim the child and the EIC. The one who claims the child gets the EIC. If he paid more than half of the cost of maintaining the home and claims the child he can file as Head of Household and claim the EIC if he's otherwise eligible.
If you claim the child you must file as Single since you didn't pay more than half of the cost of maintaining the home. You can claim the EIC though.

If his income and age were such that he could claim the earned income credit even if he was not claiming your child, then he might have a shot at claiming the same amount of earned income credit with claiming the child. He cannot get more earned income credit with the child than without the child. He cannot get the earned income credit if he could not get it without the child. Claiming the child will not affect his earned income credit. If you lived together in a place where it is illegal for you to live together without being married, then he cannot claim you. If you lived together in a place where it was legal to do so, then he might be able to claim you.

Is he the baby's bio father? If yes, then if his income is within the EIC limits, he could get EIC if HE claims her, not if you do.

No. You file as head of household with one dependent. You are not married so he files as single
