Do I need a new title?

I live in PA and i have a car which is in my name and my father's name. My father passed away last year and i need to have his name removed from the title in order to junk the car. I called the tags place and they told me that i would have to fill out a reassignment form. I was wondering if i would also have to get a new title as well? that's a question that i forgot to ask the lady at the tags place and it just came to mind, that's why I'm asking it. Thanks.

    In my state you can reassign the title with an heir to a vehicle form if you are the closest next of kin. If your father had a living spouse they would get the vehicle. You may be able to find your answer by contacting www. pennsylvania.gov and looking for a link to your DMV.

    Yes you need a new title and the form she told you to fill out will get you that new title. You will probably need a copy of your fathers death certificate.

    You just need an affidavit which is a power of attorney signing in place of your father.

    And you might not even need that to junk it. There is a junkyard about 10 miles from me that says :"I buy cars-no title needed".

    Most people with junk cars are not stolen, they are just junk and not worth spending the money on and then waiting for a title.

    That said, its ILLEGAL to sell any car that is stolen.

    If I were you, Id sell it on craigslist, sign your dads name & give them a bill of sale with your dads name and not worry about it.

    Whats going to happen ? Is he going to come back from the dead and file charges ?

    Yes, you will get a new title. If the modifier between your names is "or" you should have no problem making the change. If the modifier is "and" you may need to bring a copy of the death certificate to get the change made.
