Do you get the childcare tax credit for a child care provider who is not licensed?

    There is nothing in the Tax Code that requires that the provider be licensed for you to take the credit. (Unlicensed providers MAY have problems claiming certain business expenses but that's an entirely separate matter.)

    Daycare licensing is a local matter. Not all jurisdictions require licensing or registration of daycare providers, especially the small operations with only a very few children in their care at one time.

    you make sure you get their SS#, address and name, you can claim the credit without a licensed provider

    not all providers are licensed
