Do I have rights to see my grandson?
My son is in jail and my grandsons mother wont let me see him. i have always been there for him, diapers, formula, holidays, outings weekly. I love him to death and we are close. She lies constantly about everything, is bipolar and wont take her meds, and drinks heavily and is abusive. After texting me horrible messages that social services took her kids after an incident that took one to the hospital, i myself called social services to find out what was up. The kids were not taken but she is now under investigation and being drug tested 3 times a week. She thinks this is my fault when it is all her own doing. i want to see my grandson. One because i love him, and two to keep an eye on what is happening around him. She associates with total lowlifes and hangs out with teenagers even though she's 28. My son is 20. Go figure. Can I sue her for visitation, and actually get it? im an upstanding, responsible person who doesnt drink or use drugs has no criminal history and live a decent life with my husband. We only live 3 miles from my grandson in a small town. it kills me to see him in his stroller wave at me when I drive by.

You can take her to court for visitation rights since your son is absent.
The court will give u visitation. You have to apply for it though through the courts.
They will give it to u straight saway , considering her history.
It would be easier to speak to the mother, saves on court costs. But u want something permanent, not something based on a verbal agreement.
Speak to a solicitor.
Its worth every penny u spend on legal costs.

Nope; in a Washington case it was held that grandparents do not have rights to visitation. NOW if you can work with social services to prove she's unfit and if custody is taken away, grandparents are prime candidates for being the guardians of the children.

Go to court and file for immediate custody on a basis of safety concerns. Make sure you take any documents you have supporting her being unfit included witness statements saying she is unable to safely care for your grandson.

of course it depends on what state u r in. as for california, grandparents do have rights. and yes, u can petition for custody, especially if cps is involved already. i know more than one grandparent who took their grandchildren from their unfit parent. and even if u dont get custody, u have rights to be able to have visitation. check on line or somewhere with your states laws on this. their r also sites online that offer free help regarding law questions. good luck.

Grandparents do have legal rights to visitation...... get a lawyer and take her to court.... then you at least have a court order for reasonable visitation.

Sounds to me like you need to get a lawyer to see what exactly your rights are (it differs from state to state)

you could try for grand parents rights, but you will have to have a lawyer and it will cost ya. good luck dear.
