Is it legal to rent a boat slip to a neighbor on a private dock which is permitted by US Corps of Engineers?
We are considering buying a home on a lake. The lake is all US Government owned. This home comes with a boat dock on the shore. The US Army Corps of Engineers manages the lake property. If you own property next to the lake they will issue a permit to allow you to place your private boat dock on the lake.
The question is, if we bought this home, could we then rent the boat slip to a neighbor, because we have no interest in boating. Do you know if this is commonly done? Are there any laws which would prohibit such a rental? Please give us the benefit of any experiences you may have on this topic.

Yes, you can rent or let someone keep their boat at your dock. The question is do you really want to. advice to you is think long and hard about it, there are other issues that may arise from it. If it is a good friend, or family member (someone you know and trust) the issues are not as great then if you rent to a stranger. Here are just some concerns for you to look into.
1) Your homeowners insurance.
Find out if your rates are going to be higher, because now you have a boat on the property. What your liability for that boat? If the boat is damaged on your property are you responsible for damages?
2) Corps of Engineers.
Corp of Engineers / Government owned lake are stricter then most. Find from them as well what your liability, and responsibility is for the boat. If that boat is at your dock (on your property), you are responsible for any additional fees, or taxes to keep it there, and do you hold any responsibly for the actions of the boat when it is on the lake. Let me give you an example of what I mean, and this is worse case scenario: The owner of the boat goes out on the lake one night, their drinking and partying, they have a bad, accident and kill somebody. They freak out and leave the scene, and bring the boat back to YOUR dock. Now granted, all boats have registration numbers on them (like a car license plate) that are registered to the boat owner. Now because that boat is on your property, and you have access to it, whether you like boating or not, USCE may say that they have no way of knowing who was driving the boat, even though it is registered to him, it's at your dock. What if the guy say's "I didn't take the boat out that night" guess who's next in line. I am sure they would figure out the truth, and that it was him, and not you, or at least you hope they would!
3) Boat owners access and misc. nightmares.
If it is a stranger, is he allowed to come, and go when ever he wants, can he bring who ever he wants. Is he allowed 24 hour acces. Are you responsible for what he keeps on the boat.
Just think about it first, the money you make for the rental of the slip just might not be worth it.
