Do they do background checks when buying a home?
My fiance and I are looking to move out of our small apartment. Problem is he has great credit and makes more than I do, but he has felony arrests (but no convictions) they still turn him down at apartment complexes. They will be erased from his record in a little less than a year but not the best timing. I have a good record but am not approved for some apartments (or I'm going to guess mortgage loans as well) because of my wages and I haven't established credit yet. So he would have to get approved for us to move into a better situation, and possibly a home, if we combined our income. Will background checks be grounds for denial on a home?

If there is any sort of HOA they can decline to allow him to live in the neighborhood.
If he is getting a mortgage he can be declined as he is awaiting trial and may very well be in prison in the near future, leaving no one to repay the loan.
If you are sure these will go off his record soon you should just wait and avoid all of the stress.

It is important to keep in mind that a free background check on the Internet will only take you so far and also that some companies may only update their information periodically therefore you may be looking at information that is no longer relevant (such as an address for example). Before beginning a search on someone else consider doing one on yourself to see what information you come across. Is the information accurate or not?

They might if you are moving into an area controlled by a home owners association. But if you are buying a home that isn't under any associations, then there shouldn't be any back ground checks.

For one, being a felon doesn't absolve one's right to own property. For two, he's not a felon becasue simply being arrested does not equate to a felony. Renting is different than owning in that any criteria other than the protected classes can be used in the decision of whom one wants to rent to. Even in the case of sexual preditors, it's not the realtor's or the bank's obligation to see that one is in compliance with any court orders.

If the felony didn't involve any sexual harasment or something likely, there should be no problem in doing so.
