Most artists will not rip-off another artists work. It’s up to the individual tattoo artist.

I think it's going to be one of those situations where some would consider it rude and some not. The best thing to do would be to go to a reputable tattooist and ask them their opinion, if they feel strongly enough that they would not tattoo the exact same design perhaps a compromise could be made by using the design as a basis and adapting it to be personal and specific to yourself. I design tattoos for people myself and whilst some people ask for "just that design", half the fun is creating something brand new and personal for the next person. But of course if you're absolutely head set on that design, if you can get someone to create the outlines for you I doubt many tattooists are likely to argue with the custom.

Absolutely. They'll tattoo anything you can come up with. Especially if you have a picture, but if not you can describe what you want and they'll draw it up for you.
