insurance policy has been declared void?

hey guys, Il try 2 keep this short, last year my boyfriend got a car on finance and set up his insurance policy and added my step dad as 2nd driver, my bf is main driver but my stepdad is named as policy holder which we nw knw is wrong, my bf was involved in a crash on the 28th june (nt his fault) and we hav bn fightin with the insurance co 2 collect the car 2 assess the damage, thy called 2day 2 say that the insurance policy was void and that he has 2 pay 5700 to repair the other car, any1 know wer he stands?

    Here's the long answer - if your boyfriend was not listed on the policy and he was the main driver of the car, then your boyfriend was engaging in insurance fraud. Insurance companies are not stupid. They know people are going to think they are being slick and try this scam. So, it's pretty standard for insurance policies to have language in them that says if the car is provided for your regular use and you are not listed on the policy - then the insurance company can void the policy.

    If you made a material misrepresentation on the insurance application - that is also grounds to void the policy.

    A lot depends on where you live and the laws in your area. But, rest assured, insurance companies research coverage denials very closely. If they have denied coverage - odds are they have a very good reason and very strong grounds to do so.

    Being slick sounds like a great plan ....up until it bites you in the fanny.

    There are three issues here. The first is that your boyfriend is not insured and is liable for any costs incurred as a result of his negligence. Second, he is likely to be subject to a criminal prosecution if he is found to be uninsured at the time of driving. Third, if he was uninsured, and the other driver was at fault he would not be liable for the damage to the other driver's car. There is the difficulty of proving fault of the other driver without the assistance of the insurance company. They, of course, realise that they have no liability, and would have no reason to assist you in proving the other driver to be at fault.

    There is still the possibility that the police may prosecute the other driver for driving without due care, or even a more serious offence. My advice is to see a solicitor and take his advice.

    Your statement here sounds confusing

    If your step dad is policy holder, then he is the main driver, not your b/f.

    So step-dad can't be policy holder and 2nd driver either.

    That's why they've told you the policy is void and you and your b/f appear to have been economical with the truth
