Can I be arrested for moving back into my home?
My home is in the foreclosure process, and it has been that way for a few years now.. almost 3 years. In that time we were trying to get a short sale to go through so another company could buy our home and rent it out. But that didn't go through and nothing ever happened. Now, Bank of America bought my mortgage and we still haven't gotten any sort of sale date. I moved out with my husband for a short amount of time to live with my mom so she can help take care of me, as I've become disabled. We want to move back into the house so we can save up to move into our own place, with out the stress of living with other people and a sale date hanging over our head, and to file bankruptcy.. could we get arrested for moving back in? We left a lot of our things there and we've kept the lawn mowed and all that. I know I look like a bad person, but I'm not. I'm just really really unlucky. Disabled into a wheelchair, back so bad I get moments of being paralized and so forth, and no money for the doctors to prove my disability.
My home is not in full foreclosure yet, so no, it has not been reposessed by the bank and I was even told that I could stay in my home till the actual sale date, which hasn't even been posted.

That house no longer belongs to you, if someone or some bank now owns the mortgage. You would be trespassing and squatting, so yes, you can be arrested.

If the locks haven't been changed, and the property hasn't been posted as foreclosured, then technically you still have a right to the home. You can move in.
I find it hard to believe though that it hasn't been posted after 3 years. You may want to be certain of your facts before moving back

Very sad, I know what you mean. my parents were very close to foreclosure. but it is illegal.. the bank now owns your home.

Notify the bank that you have property that you want to remove. Send it certified return receipt requested.
