Can my daughter get a public defender for breaking her lease?

My daughter moved out of her apartment at the end of September because the boyfriend of the landlord moved in and many guys were in and out of the apartment. One night, a guy walked in her bedroom that she didn't know. When she moved out, she offered to pay October's rent if the landlord would sign a termination letter stating she could break the lease. Well the landlord didn't agree. The landlord's Aunt is an attorney and my daughter received a letter stating that if she doesn't pay 600.00 by the end of December they are taking her to court. If this goes to court, can my daughter get legal representation? She is a college student and only earns 3000.00 per year.

    No, this is not criminal. She will lose anyway, so she can represent herself.

    She will owe for the duration of the lease. Since wage garnishment will give the landlord 25% of her income she can request it does not start until she is out of college. That should be granted. But keep in mind judgments get 10% interest, sp she will owe more the longer she waits to pay it. She will also have to pay the landlords legal fees.

    Your daughter cannot get a free lawyer.

    However, she needs to write down all the things that happened when they happened in bullet points to be able to present. I also advise seeking a lawyer. This if the facts are as stated an open and shut case for your daughter. The landlord cannot move someone else in her apartment without her consent. If he did, she had every right to leave. Find a tenant lawyer that does a free consult and go visit. A lawyer would have a field day if the facts are as stated - your daughter may be able to even sue the landlord for damages!

    Public defenders are for criminal matters - not civil.

    She will need to hire an attorney to defend her. But it would probably be cheaper to pay the $600 or just live out the remainder of the lease.

    NO nor does she need one. She attends the Court Date, pleads her case and lets the judge decide or pays the 600
