How do I go about asking the judge for a defered finding?

Basically, I was taking my children to school and my 6 year old took his seat belt off and as I reached behind me to grab him I inadvertantly went down on the gas and was clocked going 35 in a 25 mph school zone. What I would like to do on my court date is ask the judge to allow an entrance of a defered finding so that I can attend a safety class on driving, receive the certificate, and then come back to court to show proof that I attended and passed-this will allow my record to stay clean of any negative points and wont raise my insurance.

What is the best way to ask the court for this? Should I have a copy of my driving record with me so he can see my history is clean and are there any other forms I should have pre filled out? thanks.

    The type of hearing you will have is a very relaxed atmosphere, you ask the judge for the deferred and explain what you propose to do and the judge will most likely approve it if not you will have to pay the fine and move on.

    A lawyer is needed to do this. The first visit is usually free.

    Call the court clerk and have it rescheduled . At least that s the way in NYS
