Can I give my landlord 30-days notice in the middle of the month?

I rent a basement unit in Vancouver, BC. In the beginning I signed a six-month tenancy agreement, which ended a few months ago and we both agreed to revert to a month-to-month basis. I'd like to move out now but it's the middle of the month - do I have to wait until the end of the month to give my landlord 30-days notice (i.e. have to pay him another month's worth of rent), or can I give him 30-days notice now and save a few hundred bucks from next month's rent? FYI, I'm moving because the instant-water heater (furnace) for the WHOLE house is located in my unit, and now that he's got the heat turned on in the winter, that thing is on ALL THE TIME - this makes sleeping nearly impossible.

Thanks!

if you give them notice today 11/20, if would become effective on dec 1 and you would owe for the FULL month of Dec (no matter the day you move out) and you would have to be out by dec 31.

Depends on your landlord and your rental agreement. Did you get a new rental agreement when you changed to month to month? If it doesn't mention on there that you must give 30 day notice on the 1st of the month then, see if you can do it now. Talk with the landlord.

Once, I have told my landlord that I was leaving Jan 15th which was many years ago and she accepted it and allowed me to pay only half of the rent. So like I said, depends on your landlord. If you have a nice landlord, then maybe discuss about paying half of next months with a written agreement (very important to have in writing!!!) that you will leave by specific date say like Dec. 11th. Also make sure the apt is in good shape. That also helps too because that would give the landlord less work to clean up for new tenants and many landlord appreciate the efforts. Everyone knows that the economy is not great, so if you have a good relationship with the landlord, then s/he would understand. You can even agree to let the take portion of the deposit.

If your rent is due on the 1st of each month, I would think the landlord is going to assume it will be 30 days plus however many until the next 1st of month (example: if you do it today, will need to be out end of Nov and pay all of Nov rent).

The only way it would be expected for you to vacate in the middle of the month is if your lease states a prorate can be agreed upon. Ask your landlord, they may agree but get it in writing if they do.

If your rent is due on the 1st of the month, you need to give notice by Nov 30 that you will be vacating by Dec 31. Unless the landlord agrees, you cannot give notice today to be out by Dec 1 and avoid paying the entire month of Dec. He is legally entitled to the entire month of Dec.

Unless there was something in your lease that said 30-day notification for a month-to-month lease is defined as starting on the 1st of the month after the tenant gives notice (some leases do say this), then just 30 days notice is sufficient. Check your lease. Even though you fulfilled the lease, terms specifying month-to-month rental may still be valid.

Usually rental agreements start and end on the first of every month, that is why you sometimes have to pay a pro rata portion if moving in mid month. You need to discuss this with your landlord as he might accept a mid month notice.

most states in the US requires ONE FULL RENTAL PERIOD NOTICE - this means that you have to tell him by the date that the rent is due, and then its 30 days after that that you're responsible for.

Have you told your landlord that the unit is noisy? It shouldn't be that noisy, maybe it's something that can be resolved.

if you pay your rent on the 1st of the month, you would notify them at that time you would vacate before the next payment of rent is due(at least 30 days)

As long as you get 30 days notice, they do not have to wait until a special period in time to give it to you.

u can give one any time you want--and it is expected that you will leave 30 days from that day.

and you will pay the full mo rent the next mo and get it back proportionally + the deposit back
