She's from Brazil has overstayed her tourist visa, has been here over 10 years, has 2 children born here and it's now married to an active military member,no crimes, hasn't left the country since coming here.Any ideas, pls be kind! And thanks in advance for your time ;)

Update:

Thanks for all the replies, another question, should she start working on the I-601 now and send it in or wait to see if they will require her to do so?

I assume she filed for AOS from a B2. The overstay and working without authorization are not an issue at AOS. If they filed I-130, I-485- and I-765 (optional, yet "free" when filed concurrently) correctly and added a check for the correct amount (fees went up on Nov. 23), there should be no problems to anticipate. The whole shabang will take about 6 months and the NOA1 should be in the mailbox about 10 to 12 days after mailing the package off.

2-4 weeks it normal to get Receipt Notice. After 30 days, still no RN, then contact USCIS.

Due to her 10 year overstay, she might need I-601 Wavier. Consult with experience immigration lawyer.

Should be OK as she originally came with a tourist visa.

Though she should have done this immediately after getting married.

And she better doesn't leave the country until she get a greencard. If she had left the US she wouldn't have gotten back in...

she will probably have to leave the country if she is an illegal

An illegal cannot adjust status in the US

Marriage and babies will not help either ..that is a myth

To become legal you have to return home

It could take up to two weeks, depends on how many cases they are working on, if nothing within two weeks she could call and check on her app process
