Default notice from court re: CreditCard?

Please help. My mother who is elderly and on a very fixed income racked up huge credit card bills. She was unable to pay them and simply stopped paying. One creditor hand delivered her a summons. She did not show up for court or answer the summons. Now she has received a notice of default. I have been in contact with a bankruptcy atty. to help, however, he is not aware of this and he has not officially filed. (This should be happening soon) Mom lives in Michigan. She does not have the means to pay these credit card bills, even in part. What exactly does this Notice of default from the court mean? Will they garnish her social security or her small pension? Any help that you can provide would be great. Thanks!

    It means that your mother ignore the summons to appear in court. Therefore, the court granted the creditor a default judgment against her.

    Social security payments, pensions, disability payments, welfare payments, alimony, and child support are exempt from garnishment for consumer debt.

    Keep in mind that her bank accounts are not. In order to protect her bank account from seizure she needs to take precautions. Keep the monies from the above sources separate from all other income that she may receive. Don't mix funds. She needs to contact her bank. There are forms she needs to sign and fill out that will protect her social security and pension once it hit her bank accounts.

    If you mother's only income is her pension and social security, and if she has no assets, Then there will be no need for her to file for bankruptcy (the creditor could still put a lien on her home or any other property that she may own).
