Can you go to jail for this?
My boyfriend shot his step dad in the stomach,because he was going to rape his mom. (The step dad was drunk) The step dad is now in the hospital and i was wondering, could my boyfriend go to jail for it?

He may and he may not.
It will depend a lot on if the evidence supports or contradicts what he is telling the police.
Generally, in a self-defense case, then no, he wouldn't. However, if he says that the step father was going to rape his mother and yet, forensic evidence shows that the step-father was sitting in the chair, half passed out, then he could be charged with attempted murder.

Sadly, this question needs vital pieces of information because it could go either way.
What State was he in?
Who is the registered owner of the gun?
Why did your boyfriend have the gun in his possession?
Did any level of action take place before to deter the event prior to the shooting?
Did you mom verbally say No without implying anything else?
This could end up very bad or be ruled an accident. Your boyfriend could be charged with attempted murder, aggravated assault, and some gun crimes OR be let off completely free under a Good Samaritan Clause or extended Self Defense of a family member.
The step dad could be charged with domestic abuse, sex crimes, drunk and disorderly conduct, mandatory AA, or some variation of those.
Best bet is to have all sides drop any charges against each other and see if the state presses charges. If the state tries to press charges, see if a counselling session for drinking/anger/sex crimes could be the sentence.

It doesn't look good for him. I mean the way you make it sound it sounds like his dad hadn't actually done anything yet. I'm not sure but he's prob not getting away from this clean.

If your boyfriend's mom was crying for help and your boyfriend intervened, then he shouldn't be jailed... I'm not a lawyer so I'm sorry I can't help.

I think that would depend on whether or not the mom would take his side and verify, and maybe even if she presses charges or not.
