Nothing unusual in that. It has been found to be unconstitutional by three separate district courts, and Justice Scalia has suggested in prior opinions (dissenting) on gay rights cases that the reasoning of the majority in those cases would apply to gay marriage.

It is not unprecedented for an administration to decide that a law simply can't be defended. Nothing prevents individual members of Congress from intervening to defend the law. Additionally, for the most part, DOMA does not impact the federal government as much as it impacts states and private businesses (e.g. hospitals, insurance companies) that treat spouses differently from housemates. The states and private businesses are still free to assert DOMA in court.

Nothing new, they are suing Arizona for putting in place laws that are identical to Federal laws so that they can enforce Federal Law since neither party wants to enforce our illegal immigrant laws. Matter of fact, just recently we had an illegal immigrant who was suppose to be exported because of being convicted of violence finally killed people.
