My fiance is a Filipina- Need help!?
I'm in a complicated situation. I'm an American working in South Korea with an E2 Visa. I will be marrying my fiance in The Philipinnes in October. At that point, we both want to return to Korea. The problem is, we have to wait 60 days for our marriage certificate.
How can my spouse come to Korea with me after our wedding and look for a job here?
Also, do I have to wait 60 days for my Marriage Certificate before I can begin the Visa paperwork for her to come to America as my spouse? She'll be looking to get her American Spouse Visa (K-1 Visa) while living with me in Korea.

If 60 day wait for marriage certificate is according to Philippine law, then there is nothing you can do but wait. Bringing your then wife to Korea, you must follow Korean immigration law. It has nothing to do with US immigration law. It is likely that she may able to apply spouse of E2 Visa once you get married and get marriage certificate at Embassy of Korea in Philippines. Contact Korean Embassy in Philippines or Korean Immigration Authority.

By the way K1 is Fiance visa. Once you get married, you cannot apply K1. You must process CR1 Immigrant Spouse visa. If she is qualified, she may process US Embassy in Korea, but that is totally up to the policy of US Embassy in Korea.

does sound like a problem. I don't think the Koreans will consider issuing her unless you can prove she's your wife. same thing with filing a petition for her at the US embassy. you simply can't file a petition if you don't have a marriage certificate.
