HELP - Noise From Neighbors A/C?

Can I sue for the loss of sleep and damage to my health and constant irritation? (My head feels like it is going to explode! My blood pressure is rising, I get no sleep and feel like my ears will start bleeding)

Living in a condo. For a month now - despite the fact that the night time temperatures have been 35 to 46F and the daytime temperature was over 60 maybe twice - the next door unit has his air conditioner on almost non stop and it is sending noise and vibrations throughout my condo practically non-stop.

The sound has been described as -either a treadmill, a running dryer or a washing machine in the spin cycle - mmmm, mmmm, mmmm, mmmm, mmmm, mmmm, mmmm, mmmm, mmmm, for maybe 8 minutes straight and then clunk (like the end of the spin cycle), within a minute it started back up. Imagine this over and over and over and over all day, all night every day for a week (and then for a month). The first week I never got more than an hour sleep - moving right by the television all night. You can feel the vibrations.

I have found plenty of evidence that this is harmful to your (my) health and in not unheard of with these air conditioners. They are split heat pumps, with an internal unit and a compressor outside - BUT.... the compressors are outside the other condo, not directly touching my wall. The vibrations can be felt and heard throughout my entire unit. I am in VA.

Update:

No they are not NORMAL sounds. Every one (who was not responsible for fixing it) acknowldedge that it was abnormally loud and strong. Hearing a fan - or hearing it from OUTSIDE is normal - having constant motor sounds and vibrations is indicative or a problem - either with the condenser, how/where it attached or grounded, or along the lines into the condo walls.

I have stood by people and hummed (replicating the sound as closely as possible) and every single person has either looked away, moved back or hheld their hand up indicating that I should stop - IN LESS THAN 10 SECONDS. . imagine living with this CONSTANTLY for a MONTH!

    Everyone forgets that there's an HOA (Home Owner's Association) in all condos. First you complain to the HOA about a malfunctioning A/C.

    Then you can write a letter, send it certified to your neighbor giving them 30 days to correct the problem. If they igonore it (99% will), the next step is to take sound level readings next to the unit and inside your room. Radio Shack or other places have cheap meters for audio setup you can use.

    Most all cities have a noise level law for exactly this reason. You have a legal right to what they call "quiet enjoyment" to your home. If the sound level is above the legal limit, you can complain to the city inspector to enforce it.

    If no sound level law in your city, take him to small claims court with a recording of the sound and the time of day it goes on and off and the duration. Build your case, so the judge will be on your side.

    Also get a doctor to examine you and give you a letter that sleep deprivation and other problems are the result of this annoyance.

    Those are normal sounds A/C. He may be running his early in the season because he has a breathing problem that requires it. Most in VA have A/C. It gets to hot there to live without it

    I think noise is not so high to sue it in courts as well. To my end you should talk with owner of the house. And suggest him to change location of AC. It is best solution i guess. Last decision will be yours.

    You do not have a viable reason to break your lease and no you can not sue the neighbor as he is allowed to use his air conditioner as needed. You should try ear plugs and/or move. Read you rental contract/lease and you will find out what the early termination cost will be.

    as long as the noise level does not exceed that permitted at night by local law, there is nothing you can do short of moving away.
