My significant other and I have a child, we are not married, nor is there any court order in place in regards?

What should I do? I want to leave and take child to AZ without her permission. Do I have the legal right to do that? We live together but as I have said there is no court order regarding custody and we are not married.

    Look up the laws in your state regarding unmarried parents where there's no custodial agreement and/or contact your local Legal Aid or an attorney.

    Nope, she's the natural mother and you'd only end up being sought by police for child abduction. Living together and having a child is legal grounds without any court papers, it's the law statewide across the continent and is what courts operate from. If you need to, please speak with a lawyer but they'll tell you the same as I am. The best you could do is leave alone but get a court ordered visitation schedule between you and the mother. The law's the law, you don't want a criminal record or jail time, I expect.

    You would have to go to court for no matter what. When the baby got a birth certificate it was put into the legal system. IF you take him with out here permission or a court order you will be charged with kidnapping. If there is no birth certificate. Then you could take him but again she could just charge you with kidnapping.

    Go to courts and you could loose the custody of the baby if you have a job or not.

    No one has the right to take a child across state lines without the permission and consent of the other parent - married or not married.

    Doing that is called 'kidnapping,' and if you do it, you'll go to Federal Prison.

    Its called kidnapping. Its illegal to do as you are saying.

    You and her have to talk, and yes, you have to gain custody of the child through the court.

    Nope. You have no right. She'll come after you. You have to get legal permission to show that she is a bad mother, that is the only way.

    I would think if you can get some sort of document with her agreeing and signing it, then it might be legal but the best thing to do is consult with a lawyer to be sure, you do not want to be someone who is thought to be a kidnapper.
