Obama breaks the War Power Act, denies congress the ability to vote for continued attacks in Libya, thoughts?
http://blogs.abcnews.com/politicalpunch/2011/05/wh...
Obama's 60 free days of war granted by the War Powers Act (which was to give the executive war powers in case of an "emergency" requiring fast action) are up since Friday, I asked a question about this, and I was surprised that it was simply flat out denied. I was expecting tension in congress more so than no option.
This seems like abusing the war powers act since we were not in any threat from Libya (attacking Libya might even raised our risk), also they did not attack any ally Nato country either. The war power act was not meant to be used this way. He used the act to go into Libya without provocation, and he is now saying it isn't applicable to stop what we are doing.
I take less issue with 1, and more so with 2 and 3, as if that didn't constitute as war when you shoot missles and explosives into another country.
What are your thoughts?
I find it hard to believe that state sanctioned shooting of missiles and blowing up targets does not constitute as a military action.
Congress should be required before theaters of shooting or blowing up targets are opened

From what I can see (and I don't claim to be a legal scholar), I DO believe he is abusing the War Powers Act (strictly speaking). I believe the right thing to do is to get congressional approval to continue whatever actions we are engaging in over there. I THINK what he MAY be doing is setting precedence, just like he did with Osama Bin Laden, which was basically an assassination and not the "justice" that he called it.
The problem with both of these actions is that it's as much of a slippery slope as the Patriot Act is. How long will it be before America starts detaining American citizens as political prisoners? Is it really that far of a stretch to totalitarianism or even tyranny when each president takes it upon himself to extend his authority? Tyranny might still be a bit of a stretch under our current government, but remember-our leaders can justify just about ANYTHING under the auspices of the "war on terror."

The war powers act is thought by many scholars and most presidents to be unconstitutional, and that the constitutional recourse for congress if they want to stop what the president is doing is to cut off funds. A resolution does not replace a Declaration of War.

Obama does not run Congress. Boehner could make an issue out of this and rightly vote on articles of impeachment, but he has no appetite to spend his political capital in a fight over bombing Libya and the much hated Qaddafi.
It seems petty politics runs our country far more than rule of law, but looking an American history, something tells me it has always been somewhat like that.
The practice of checks and balances definitely needs to be a key part of all branches of government, instead of just as a conceptual idea no one takes seriously.

Carter went to Iran yakked on the tube and presto it's over and thousands are executed. Obama goes to Egypt yaks on the tube a dn presto. Why in the world undermine so many government regimes at one time. In Egypt will the Coptic Christians live and why kick the government out an d leave a void.
Same goes for libya

If congress will not exercise their check here.....then? Further bad precedence for future administrations (in which the same folks defending such unlawful activity now are very likely to be crying a different tune then).

I don't have thoughts any longer on this issue, I have statements:
NATO, your agression against Lybia is illegal, halt your activities against that soverign nation.
William Hague, Nicolas Sarcozy and David Cameron, hand yourselves over to the police. The police, arrest those low lifes if they fail to comply within a reasonable time frame, say 24 hours, voluntarily.

Eh, i think your post is a little bit misleading
i'm not saying i agree with his decision, but this is right from the first paragraph in that link you posted
"President Obama wrote a letter to congressional leaders this afternoon suggesting that the role is now so “limited” he does not need to seek congressional approval."
I mean, 99% of what we're doing is just reinforcing the no fly zone, i wouldn't really say we're at war.

If Obama was Bill Clinton they would be talking impeachment.
Does anyone know why they're letting this "wonderful leader" off the hook?

America's gangster-capitalists are utterly lawless. They kill, steal, rape, loot, deal drugs, launder drug money, etc with total impunity.
