Do I have a case age discrimination?

I was at a store in Long Island NY where the smoking age is 19. I am over 19 I entered the store to buy my cigarettes and I brought my sister with me and the clerk asked her for ID. She is 17. She said she didn't have it with her and the store would not sell it to me because their policy states that if a minor is present, they can sell age restricted products only if a customer is over 40, this is age discrimination. How would I go about reporting said store? What agency? Thank you!

    Sorry, it's not age discrimination. Age discrimination is when people won't hire you and you are over 40.

    It's quite reasonable for that policy because you could be buying the cigarettes for a minor. In fact, I applaud them.

    Give up the habit dude, it's killing you.

    No, this seems like more of a case where a store has the right to refuse service to anyone. The store's likely contention is that it is trying to prevent minors from coming into possession of the cigarettes. Too many people pull that scam where they have a legal person purchase their cigarettes or beer and then receive it indirectly.

    All-in-all: You do not buy things with a person who is prohibited from doing so (i.e., leave her in the car). Unfortunately, I doubt any lawyer would take this as there really does not seem to be a case here.

    Under NY law they can set policies to keep illegal substances out of the hands of minors. Sorry but they did not discriminate by age.

    Give it up. Age discrimination is for forty and older in the workplace.. It may not seem fair, but stores have a right to protect themselves.

    A business can lawfully select with whom they do business, based on any criteria at all. This includes hair color, height, age, or any other characteristic.

    Do not confuse private business with government process.
