Can churches who refuse to marry Gay Couples lose their Tax Exempt Status?

There is a precedent that could be used for this case.

    No. A minister can refuse to perform a marriage anytime. And churches and private clubs can select their membership on any basis they like. But Bob Jones University was an educational institution, holding itself open to the public, that racially discriminated. It was not closed down. It just could receive federal tax benefits because it acted like a private club instead of a charity. When they changed their policy of prohibiting interracial relationships, they got their exemption back.

    Not in New York. A provision was purposely built into that law, preventing any legal action from being taken against any church that refuses to marry a gay couple...this is how they were able to steal a few Republican votes, otherwise, it would have never passed. There are not going to be too many churches that go along with it...but what I am wondering, will a Justice of the Peace who is personally opposed to it be allowed to decline presiding over a gay union? If not, they should be.

    NOPE.

    The new law in NYC EXEMPTS the church from performing same sex marriages.

    The separation of church and states prohibits the Government from forcing the church to do anything.

    What was won in NYC was "civil unions". The same civil union they have in several states.

    A civil union is where a couple can marry at the court house.

    I am a woman and my first marriage (to a man) was at the courthouse in 1975. It is a legal marriage not blessed by God.

    If the Gays want Gods blessing they should drop to their knees ask forgiveness for their sins and ask for the blessing. Just like the rest of Christian America does.

  • The states which have legalized gay marriage have all exempted churches from having to marry anyone. Churches are private organizations, they can refuse to marry ANYONE.

    The case you cite relates to educational subsidies and tax status on an operating business, it is a different situation.

    Churches have always chosen who they will marry in the church. You should see the requirements to getting a formal Mormon marriage. They even screen the visitors to the wedding.

    Catholics also are strict on marriages.

    Freedom of Religion means freedom from govt demands.

    Pastors do not have to marry everyone whyo walks in a requests to be married by them. They often will counsel with the couple and sometimes refuse to marry them. There are government officials who can legally marry couples as well, it does not have to be a minister.

    Nope. If churches lost their tax exempt status so would alot of public services that are pro bono. Churches don't make a profit beyond running the church.

    Government cannot define a marriage. It is not within their power. Marriage is between a man and a woman. Because government can say red is green, does not make it so. Same sex unions are not marriages no matter how much they might want that to be so.

    As soon as they realize that they can make a ton of money then they will allow it. Because at the end of the day Money is the true religion of the the US.

    Theres a provision for that as well, I think. But there will always be people that will marry them because of the money gays are willing to spend.
