Can you be acquitted of 1st Degree Murder, and then charged with 2nd degree?

or is it the other way around?

    No. it doesn't work that way. If you are acquitted of killing someone, regardless if you were charged with 1st degree murder or manslaughter, you cannot be charged again for that crime.

    In most circumstances? Yes you could. In some cases though they charge with both 1st AND 2nd degree(like Casey Anthony) and if you are acquitted of both then both are off the table.

    NO, in the Casey Anthony case she was acquitted of all charges except lying to the police, she has been in jail for 3 years and may be released on Thursday on time served.}{
